Dealing with the estate of a loved one can be a complex and time-consuming process. We can provide as much or as little assistance as you require, from helping with the Grant of Probate application through to managing the full administration of the estate.

The complexity of an estate varies depending on the circumstances. Straightforward estates may involve a valid Will, a small number of assets and beneficiaries, and no inheritance tax or disputes. Additional work may be required where matters involve:
Disbursements
During the administration of an estate, there may be additional payments payable to third parties, such as probate fees, searches, and notices to protect against potential creditor claims. We will advise you of any applicable disbursements as the matter progresses.
How long will probate and estate administration take?
The time required will vary depending on the assets involved and whether any complications arise. For many straightforward estates, the Grant of Probate is usually obtained within approximately two to three months. Once the Grant has been issued, collecting in the estate assets can typically take a further one to two months, after which estate accounts can be prepared and the remaining assets distributed — often a further one to two months.
These timescales are a general guide only. Where an estate is more complex, the application for the Grant of Probate can sometimes extend to around six months, and the administration period may increase where assets are difficult to locate or transfer, tax matters require attention, or disagreements arise between beneficiaries. In these circumstances, completion may take a further 6–12 months. We will provide clear advice on likely timescales once we have reviewed the estate, and keep you informed throughout.
Please note that the sale or transfer of any property forming part of the estate is not included within the probate administration service and can be dealt with separately by our conveyancing team.

Many people assume that their spouse, partner, or children will automatically be able to make decisions on their behalf if they become unable to do so. However, this is not the case.
A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint one or more trusted individuals (known as attorneys) to make decisions for you if you lose the mental capacity to make those decisions yourself, or if you simply need assistance managing your affairs.
Having an LPA in place can provide peace of mind that your affairs will be handled by people you trust and in accordance with your wishes. Without an LPA, your loved ones may need to apply to the Court of Protection for authority to act on your behalf — a process that can be costly, time-consuming, and stressful at an already difficult time.
There are two types of LPA:
Creating an LPA is not just for older people. Illness, injury, or unexpected circumstances can affect anyone at any stage of life. By putting an LPA in place now, you can ensure that the people you trust are able to support and protect your interests when it matters most.
A Deputyship Order is issued by the Court of Protection and authorises a person to make decisions on behalf of someone who lacks the mental capacity to manage their own affairs and who did not put a Lasting Power of Attorney in place before losing capacity.
The Court may appoint a deputy to manage property and financial affairs, and in limited circumstances, health and welfare matters. Unlike an attorney chosen under an LPA, a deputy is appointed by the Court and is subject to ongoing supervision and reporting requirements.
The deputyship process can be more time-consuming, costly, and restrictive than creating an LPA. For this reason, putting an LPA in place while you have capacity is generally the most effective way of ensuring that your affairs can be managed by the people you trust.

For many probate and conveyancing matters we can work on a fixed-fee or agreed basis rather than an hourly rate. A clear written estimate is provided after your initial consultation, before any work begins. Disbursements — third-party costs such as searches, Land Registry fees and Stamp Duty — are payable in addition to our legal fees.
Every client works directly with a qualified solicitor — not a call centre. We keep caseloads small so you always get our full attention.

Admitted as a solicitor in 2005, Aslan is an experienced property practitioner advising clients on a broad range of residential and commercial property matters. If we are unable to resolve your complaint to your satisfaction, you may refer it to the Legal Ombudsman within six months of receiving our final written response.
